Ecomax Catering (TT Commercial Trading Ltd) STANDARD TERMS & CONDITIONS OF SALE ('this agreement')
In this Agreement,
the "Customer" means any person who places an Order with Ecomax Catering (either as a private consumer or as a business);
the "Goods"
means any items sold or supplied by Ecomax Catering under an Order;
"Ecomax Catering"
means ecomax-catering.co.uk (TT Commercial Trading Ltd), a company incorporated in England with company number 5965260

"Order"
means any request or order (via phone, web order (excluding Ebay or Amazon) or mail order) to purchase the Goods, and;
the "Parties"
refers to the Customer and Ecomax Catering

1. Ordering

1.1 It is the Customers responsibility to make sure the item/s ordered are of the correct specification, size and requirements for their needs.

2. Delivery

2.1 Delivery, on orders over £175.00 + VAT is free of charge to the Customer only, unless stated otherwise.

2.2 Highlands, Islands, Northern Ireland and Ireland are priced on application. (Please note: When ordering online we will contact you with a delivery cost based on your postcode)

2.3 Standard delivery will take place between 8.00am – 5.30pm, Monday to Friday, except bank holidays

2.4 Ecomax Catering will use reasonable endeavours to deliver the goods within the time agreed when the Customer places an order and, if no time is agreed, then within a reasonable time, but the time of delivery will not be of the essence. If, despite those endeavours, Ecomax Catering is unable for any reason to fulfil any delivery or performance on the delivery date, Ecomax Catering will be deemed not to be in breach of the Contract, nor (for the avoidance of doubt) will Ecomax Catering have any liability to the Customer for direct, indirect or consequential loss (all three of which terms includes, without limitation, pure economic loss, loss of profits, loss of business, depletion of good will and like loss) howsoever caused (including as a result of negligence) by any delay or failure in delivery except as set out in this condition.

2.5 Deliveries are kerbside/goods in only

2.6 Deliveries may be undertaken on a large 18 tonne truck (similar in size to a double decker bus). It is the Customers responsibility to make sure a vehicle of this size can access site. Failure to inform Ecomax Catering of vehicle access restrictions that result in an aborted delivery will be chargeable to the Customer. Specialist vehicle and delivery services are available but may be at an additional cost and can be quoted but must be requested in advance of the order being placed

2.7 It is the Customers responsibility to make sure site access is suitable for the item/s ordered. Ecomax Catering ask that access points and the final place of positioning are measured and assessed thoroughly. An aborted delivery due to access restrictions or the unit not being able to fit will be chargeable to the Customer. A site survey service is available but must be arranged in advance of the order

2.8 Any costs incurred due to inadequate site access shall be charged to the Customer.

2.9 If the Customer fails to take delivery of the goods Ecomax Catering shall be entitled to invoice and be paid for the goods as though they had been duly delivered. Ecomax Catering may arrange storage of the goods until actual delivery and charge the Customer for the reasonable costs of storage.

3. Inspecting & Signing for Goods

3.1 It is the Customer’s responsibility to inspect the goods upon delivery. Ecomax Catering accepts no responsibility for alleged non-delivery, shortfall of goods, or other discrepancy unless notification is received within 24 hours from the date of delivery. In the absence of such notification the Customer shall be deemed to have accepted the goods.

3.2 If the outer packaging or item/s is damaged upon delivery the Customer must ensure the courier signs to this effect and the customer must notify Ecomax Catering immediately. Notification of damage after the item has been delivered and signed for will not be accepted for any subsequent claim.

3.3 Any damage or item issues must be reported to Ecomax Catering immediately and before use. Once the item/s has been switched on and/or used, Ecomax Catering can no longer exchange the item/s.

3.4 Signing for the delivery means the Customer has accepted the delivery and agreed the items are in good condition.

3.5 Signing for goods as unchecked (or similar) will not be accepted for any subsequent claim.

4. Refunds/Cancellations/Returns

4.1 Goods despatched to the Customer and subsequently accepted for Cancellation by Ecomax Catering will be subject to an abortive delivery charge, as well as any cancellation charge deemed necessary by Ecomax Catering.

4.2 Ecomax Catering at its absolute discretion may agree to the Return of the goods by the Customer provided that the goods are returned at the Customers expense, in the same condition and in the original packaging as of the date of despatch by Ecomax Catering or their agents.

4.3 Any goods agreed by Ecomax Catering as acceptable for return for any reason (excluding faulty goods) will be subject to a restocking charge together with reimbursement of any expense incurred by Ecomax Catering as a consequence of the return of said goods to Ecomax Catering’s stock. Re-stocking fees do vary dependent on the goods.

4.4 Any goods returned damaged will result in additional charges being made to the Customer for repairs or, if the goods are beyond economical repair, the return of the goods to the Customer, at the Customers expense, and no refund being given.

4.5 If the outer packaging is damaged on delivery please ensure the courier signs to this effect.

4.6 ‘Specialist’ ‘Bespoke’ and ‘Built to Order’ units may not be Cancelled once the order is placed or may not be excepted for return and no refund given. This will be completely at the discretion of Ecomax Catering.

4.7 No goods will be excepted for Return 14 days after the delivery date.

5. Warranties

5.1 Warranties are supplied by the machine manufacturers. Warranties supplied by these manufacturers are subject to the manufacturer’s terms and conditions.

5.2 Warranties are for the machines only.

5.3 Warranties do not cover or include site services, pipe work, cabling and connections. Ecomax Catering will not be liable for any loss or damage (loss of profit or otherwise) or any other claims for compensation arising from warranty issues.

6. Installation

6.1 All installation services are based on a clear site with suitable working services (water, electricity, drainage, gas etc.) within 1 metre of the unit. Site and services alterations are not included.

6.2 Install costs are based on the works taking place during normal working hours. Monday – Friday, 8.30am to 5pm

6.3 Site access. The engineers/install team must be able to easily access the install area. There needs to be adequate space to easily manoeuvre the equipment without the need to lift, tilt, carry up and down stairs, over obstacles etc. If there is a requirement for any lifting or tilting, we must be made aware, in advance of the install date. Additional equipment or manpower may be required which could be chargeable.

6.4 Failure to inform us of site access restrictions in advance could result in additional charges and/or aborted install and cancellation fees. The customer will be liable for all associated costs.

6.5 Disconnection and removal. The disconnection and removal service of an existing unit is based on the unit being of a very similar size and nature to the new unit. If there is a difference in machine type and size, we must be made aware in advance. The existing unit must be in a suitable, manageable condition for the unit to be removed. Access for the unit to be removed must be checked in advance by the customer and Eco Catering informed of any restrictions to remove the unit. The dismantling or breaking down of existing equipment is not part of the standard removal service. The Customer must make Ecomax Catering aware of any additional works or requirements to remove the existing unit/s. We will quote accordingly if additional services are required. Failure to inform Ecomax Catering of any restrictions in advance of the installation and removal date may result in the works being aborted and the equipment being left on site.

6.6 We will aim to collect and remove the disconnected units on the same day as installation. However, this is not always possible, and we will arrange for the units to be collected as soon as possible.

6.7 If the customer chooses to install themselves or sources third party engineers, the customer is accepting responsibility for the work undertaken. In no part will the machine manufacturer or Ecomax Catering be responsible for the site services, pipe work, cabling and connections.

6.8 Machines will not be covered under warranty for machine damage caused by the Customer or third party engineers.

7. Selling Regulations

7.1 Ecomax Catering is a seller of commercial catering equipment, purchasing from us is a commercial (business to business purchase) and is not covered by the Consumer Contracts Regulations (formerly The Distance Selling Regulations) which applies to business to consumer sales.

8. Liability

8.1 The Customer agrees that Ecomax Catering will not be liable for any losses or damage suffered by the Customer including but not limited to damage to neighbouring or connected items or premises, consequential loss, loss of business, business interruption or loss of time due to the use or purchase of the Goods by the Customer. Ecomax Catering will not be liable for any additional damage caused by the Customer’s failure to report a fault or defect in good time or failure to provide reasonable access to the Goods for repairs, service or engineer visits. Nothing in this Agreement shall exclude Ecomax Catering’s statutory liability for injury or death.

8.2 Goods sold are not insured for delivery unless otherwise confirmed by Ecomax Catering.

9. Website Content

9.1 We aim to make all product data, information and imagery as accurate as possible on our website. However, there may be some variation between the product information on the website and the final delivered product. We make every effort to keep all product information as accurate as possible to reflect what will be supplied. But, due to changes in manufacturers product lines, development and their own product information and marketing material, there can be some differences. Ecomax Catering is not liable for any inaccuracies.

9.2 All content, text, images, videos and materials belong to Ecomax Catering and our partners and suppliers. You are only able to view, print, copy and distribute content published by Ecomax Catering so long as you acknowledge and agree to:

- Use the information for your own, non-commercial purposes

- Credit all copyrighted material to Ecomax Catering

Information published on our website can be changed or withdrawn at any moment and without notice. Ecomax Catering is not liable for any inaccurate information.

9.3 No person or computer is permitted to bypass any technical protections that we institute, or access, use or scrape the website by any automated means. Only those that are companies acting as a search engine may crawl our website for the sole purpose of creating a publicly accessible search index.

Intention and Commitment

ecomax-catering.co.uk is committed to reducing its effects on the environment.  Where possible the staff and management are working to prevent or eliminate the environmental hazards and impacts that a company’s people, activities, operations and products can create.  It is understood by the management that this is a long term commitment and as such will be reviewed and monitored in an effort to seek to continuously improve our environmental performance. 

All employees, customers and other stakeholders are asked to respect the environmental goals laid out in this policy and to participate in discussion about environmental issues

Method

- Putting into effect energy saving technologies that will be beneficial for the environment as well as our energy consumption levels.  
- Reduce pollution, emissions and waste  
- Considering daily activities and taking responsibility for minimising negative impacts on the environment. Daily routines such as travelling to work is one of the things taken into account and all employees are encouraged to find ways other than driving (we support the cycle to work scheme.)  
- Waste management is a key area that is taken into consideration, especially our paper. Any discarded paper is reused as scrap before being taken to a recycling bin.  
- Purchasing office supplies that have been recycled or are recyclable and local, being mindful of the carbon footprint of the product.  
- Saving building resources as much as possible in accordance to the latest eco guidelines is essential especially when considering things such as energy consumption from lighting to computer systems.  
- Expect similar environmental standards from all suppliers and contractors  
- Passing on our knowledge to help educate our clients and potential clients about environmental standards and efficiency within the catering industry is something we take pride in doing.  
- Staff training and participation

We understand that the changes we make now will have an impact on future resources in regards to the environment. Global warming is such a fundamental issue and without any behavioural change made our environment will suffer and natural supplies will decline at an even quicker rate.

Communication

All employees and management staff will be provided with a copy of The Environmental Policy Statement and training will be given to ensure everyone understands the statement and what is expected of them.  A copy of this policy statement can be found on the company intranet and on the company website.
